mogutto Consumer Health Data Privacy Policy
This policy supplements the mogutto Privacy Notice and explains how Delail LLC handles consumer health data. It is intended to meet applicable U.S. consumer health privacy requirements, including Washington’s My Health My Data Act and Nevada law.

1. Consumer health data we collect
When you voluntarily use meal settings, we collect allergy information and health-related considerations that you select or enter, including information entered in free-text fields. We do not intentionally collect precise location, reproductive or sexual health data, biometric identifiers, medical records, or information from health-care providers.
These fields are for meal-planning considerations and are not a medical consultation or diagnosis service.
2. Sources
We collect allergy information directly from you. We do not purchase consumer health data or obtain it from data brokers, health-care providers, wearable devices, public records, or third parties.
3. Purposes
We store allergy information to remember your preferences, tailor requested meal and recipe suggestions, support account settings, prevent unsuitable suggestions, operate and secure the service, and respond to your requests. The app is not a medical device, and its output is not medical or allergy advice.
4. AI data-sharing consent
Entering allergy information or other health-related considerations is optional. Before entered content may be sent to Google Gemini or OpenAI to generate requested content, we require affirmative consent to external AI data sharing. Refusing or withdrawing that consent prevents new AI generation and chat, but does not delete saved meal settings.
5. Sharing
We may disclose consumer health data to service providers acting on our instructions as needed to host and secure the service. When you separately consent to AI data sharing and request an AI feature, allergy information may be disclosed to Google Gemini or OpenAI for that request. We may also disclose information when legally required or to protect a person from serious harm.
We do not sell consumer health data. We do not use a geofence around health-care facilities, and we do not use consumer health data for targeted advertising.
6. Retention and security
Allergy information and health-related meal considerations are kept while your account remains active. You can edit or delete saved settings, and deleting your account deletes them from the active account database. Historical consent logs, provider logs, and backups may remain for applicable legal, security, and limited retention periods.
7. Your rights
Depending on applicable law, you may request confirmation, access, correction, deletion, a list of third parties or affiliates with which consumer health data was shared, or withdrawal of AI data-sharing consent. You may edit saved meal settings or delete your account in the app.
For other requests, email [email protected] with the subject “Consumer Health Data Request”. We will verify your identity and respond within the legally required period.
8. Appeals
If we deny your request, you may appeal by replying to the decision or emailing [email protected] with the subject “Consumer Health Data Appeal”. We will explain the result and, where required, how to contact the relevant regulator or attorney general.
9. Changes and contact
We will post material changes here and request new consent when required before collecting or sharing data for a materially different purpose. Delail LLC is responsible for this policy. Company details are available at delail.com.
